TERMS & CONDITIONS OF FAST INTERNATIONAL TRAVELS AND TOURS
Purpose of the Agreement:
This agreement ("User agreement" B2C and B2B ) formulates the terms and conditions for FAST INTERNATIONAL TRAVELS AND TOURS and its provide services to all User (B2C and B2B) intending to purchase the services by using FAST INTERNATIONAL TRAVELS AND TOURS website which includes Air ticket, Tour booking , Hotel booking ,Travel Insurance etc.
The Users (B2B) availing services from FAST INTERNATIONAL TRAVELS AND TOURS website shall deemed to have read, understood and expressly accepted the terms and conditions of this agreement. It shall govern the desired transaction or provision of such services by FAST INTERNATIONAL TRAVELS AND TOURS for all purposes, and shall be binding on the User. All rights and liabilities of the User and/or FAST INTERNATIONAL TRAVELS AND TOURS with respect to any services to be provided by FAST INTERNATIONAL TRAVELS AND TOURS shall be restricted to the scope of this agreement.
FAST INTERNATIONAL TRAVELS AND TOURS reserves the right, in its own discretion, to terminate the access to any related services or any portion of it at any time, without prior notice, for general maintenance , updates or for other any reason.
Besides to this Agreement, there are certain terms of service (TOS) specific to the services rendered provided by FAST INTERNATIONAL TRAVELS AND TOURS like the air tickets, holiday packages, hotel booking etc.
Such TOS will be provided/updated by FAST INTERNATIONAL TRAVELS AND TOURS which shall be deemed to be a part of this Agreement. In the event of contradict between such TOS and this Agreement; the terms of this Agreement shall prevail. The User shall be required to read and accept the relevant TOS for the service/ product availed by the User.
The B2B User will provide agency license copy, PAN/VAT copy and details of Contact person whereas B2C User too fill his/her correct information .
Later the User shall be self responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the Service Provider with whom the User chose to deal, including terms and conditions set forth in a Service Providers' fare rules, contract of carriage or other rules. If the User reserves or does not agree with any part of the terms, conditions and notices, the User shall not be avail from portal use and its services.
In the event that any of the terms, conditions, and notices contained in this agreement contradicts with the additional terms or other terms Condition and guidelines contained within any other FAST INTERNATIONAL TRAVELS AND TOURS documents, then terms of this agreement shall be prevailed.
Payment of Service Fees
FAST INTERNATIONAL TRAVELS AND TOURS reserves the right to charge transaction fees based on certain completed transactions using the service and similarly listing fees for certain listings. FAST INTERNATIONAL TRAVELS AND TOURS reserves its right to alter any and all fees from time to time, without notice. The User shall be entirely responsible for all charges, fees, taxes, duties, and other assessments for using the services. If there is a short charging by FAST INTERNATIONAL TRAVELS AND TOURS for services, listing, or transaction fee or any other fee or service because of any technical or other reason, it reserves the right to claim/add/ deduct/charge the balance successive to the transaction at its own discretion.
In the rare possibilities of the reservation not getting confirmed for whatsoever reason, FAST INTERNATIONAL TRAVELS AND TOURS will process the refund and intimate the User (the Customer) of the same. FAST INTERNATIONAL TRAVELS AND TOURS is not under any obligation to make another booking in lieu of to replacement or compensate the unconfirmed bookings/tickets. Each subsequent booking shall be treated as a new transaction with no reference to the earlier unconfirmed reservation.
The User shall request FAST INTERNATIONAL TRAVELS AND TOURS for any refunds against the NO SHOW events, unutilized air tickets or hotel booking for any reasons within 90 days from the date of departure for the air ticket and for the hotel booking the date of check in . Any applicable refunds would accordingly be processed as per the defined policies of Airlines, hotels as per the case. No refund would be payable for any requests made after the expiry of 90 days as above and all unclaimed amounts for such unutilized or NO SHOW case or hotel booking shall be deemed to have been forfeited.
Confidentiality
Any information mentioned by FAST INTERNATIONAL TRAVELS AND TOURS as Confidential shall be maintained confidentially by the User and shall not be disclosed unless it is required by law or to serve the purpose of this agreement or for the obligations of both the parties.
Mobile Number ,Itinerary information, Booking confirmation, payment confirmation, cancellation, refund status, schedule change or any such other information relevant for the transaction etc. may contact by FAST INTERNATIONAL TRAVELS AND TOURS mention emergency number given by the User at the time of booking.
Burden of proof of the User
FAST INTERNATIONAL TRAVELS AND TOURS is responsible only for the transactions that are done by the User of FAST INTERNATIONAL TRAVELS AND TOURS . Beyond this it will not be responsible for screening, censoring or otherwise controlling transactions.
The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all prevailing and applicable laws, regulations and directives regarding use of the services with respect to the concerned transaction.
The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the Services under the laws of Nepal or other applicable law.
Visa Obligations of the User
The travel bookings done on FAST INTERNATIONAL TRAVELS AND TOURS website are subject to the applicable requirements of Visa (Transit / Tourist visa ) of the destination(s) which are to be obtained by the individual traveller self. FAST INTERNATIONAL TRAVELS AND TOURS is not responsible for any issues, including inability to travel, arising out of such Visa requirements and is also not liable to refund for the untraveled bookings due to any such reason. So user must be self aware of his travel destination and should get correct information from concern Embassies/ Consulates prior to travel date first.
Safety of Data
The User agrees that any data or material obtained or used through the use of the Service is done entirely at their own discretion and risk and be will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material or data.
However, FAST INTERNATIONAL TRAVELS AND TOURS will always make its best endeavors to ensure that the content on its web portal or other information channels are free of any virus or such other malwares.
Tour Booking
FAST INTERNATIONAL TRAVELS AND TOURS website listed all tour packages which are made and designed in especial way for joyous holiday. User can search or drag in Tours section , take a brief study of tour itinerary , all inclusives and exculsives. Later book . For booking , an advance payment is mandatory via Online payment gateway presented in the portal . This advance payment holds incase if tour cancel to be made by User , charges are apply as per rule of Cancellation. Remain tour amount can be settle by either on arrival or by other payment gateway means.
We also believe in Customization of tour packages too. However few packages if User want some changes in it , can email or Telephone to FAST INTERNATIONAL TRAVELS AND TOURS's tour department . Then Tour Executive will handle all details as per requirement. So after on full satisfy you can book it on offline (Mail booking made ) with an advance payment means .
Hotel Booking
FAST INTERNATIONAL TRAVELS AND TOURS have listed Nepal's hotel booking services in the portal. Once User booked the hotel through portal , the email notification will be sent on User valid login email id for real system valid check . Payment is done via Online payment gateway present on the portal system. Here hotel booking done are not in Real Time System . So FAST INTERNATIONAL TRAVELS AND TOURS's team will first confirm with the user provided the contact no. or email id and with hotel too for room availability . Incase of unavailability , the User agrees that it is not the fault of the FAST INTERNATIONAL TRAVELS AND TOURS . If FAST INTERNATIONAL TRAVELS AND TOURS is informed in advance of such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to its customers or refund the booking amount after reasonable service charges and fees, if supported and refunded by that respective service operators.
Insurance
By using FAST INTERNATIONAL TRAVELS AND TOURS website, User can book , pay and insure travel insurance via online directly. If any claims arising User agrees to claim to concern Insurance company .
FAST INTERNATIONAL TRAVELS AND TOURS, doesn't take responsible on the claim or any other insurance formalities. It shall be as per the terms and conditions of the insuring company((Name provided of Insurance company). The User shall contact the insurance company directly for any claims or dispute.
FAST INTERNATIONAL TRAVELS AND TOURS shall not provide any express or implied undertakings for acceptance of the claims by the insurance company.
Force Majeure Events
There can be exceptional circumstances where the service operators like the airlines, hotels, providers or concerns may be unable to honor the confirmed bookings due to various reasons like climatic conditions, labor unrest, business insolvent, decision of the government, operational and technical issues, route and flight cancellations etc. In these cases the User agrees that it is not the fault of the FAST INTERNATIONAL TRAVELS AND TOURS . If FAST INTERNATIONAL TRAVELS AND TOURS is informed in advance of such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to its customers or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators.
The user agrees that FAST INTERNATIONAL TRAVELS AND TOURS being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds.
The User further agrees that due to any technical or other failure in FAST INTERNATIONAL TRAVELS AND TOURS , services committed earlier may not be provided or may contain substantial modification. In those cases, FAST INTERNATIONAL TRAVELS AND TOURS shall refund the entire amount received from the customer for availing such services by deducting the applicable cancellation, refund or other charges.
If there incurred any additional liabilities, it shall be borne by the User.
FAST INTERNATIONAL TRAVELS AND TOURS shall not be liable for delays or inabilities in performance or nonperformance in whole or in part of its obligations due to any causes that are not due to its acts or omissions and are beyond its reasonable control, for example, closure, embargo, strikes, acts of government, acts of God, fire, terrorism or other similar causes, problems at airlines, rails, buses, hotels or transporters end. In such event, the notice will be furnished promptly to the affected user as far as possible.
FAST INTERNATIONAL TRAVELS AND TOURS web site or related services, in provision of failure to provide services, or for any information, software, products, services and related graphics obtained through the FAST INTERNATIONAL TRAVELS AND TOURS web site whether based on contract, tort, negligence, strict liability or otherwise. FAST INTERNATIONAL TRAVELS AND TOURS is not responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked web portal pages.
Property of FAST TRAVEL
Logos, photographs, graphics, video or other material contained are soely property of FAST INTERNATIONAL TRAVELS AND TOURS. This material may be protected by copyrights, trademarks, or other intellectual property rights and laws.
The User may use this material only as expressly authorized by FAST INTERNATIONAL TRAVELS AND TOURS and shall not copy, transmit or create derivative works of such material without express authorization. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal as prevailing laws of Nepal and could subject the User to personal liability or criminal prosecution.
Use Limitation
Unless otherwise specified, the FAST INTERNATIONAL TRAVELS AND TOURS services are for the User's personal and non - commercial use. The User may not copy, modify, reproduce, publish, distribute, transmit, display, create derivative works transfer or sell any information, software, products or services obtained from the FAST INTERNATIONAL TRAVELS AND TOURS web portal without the express written approval from FAST INTERNATIONAL TRAVELS AND TOURS.
Indemnification of the loss
The User agrees to indemnify, defend and hold harmless to FAST INTERNATIONAL TRAVELS AND TOURS, its affiliates, their websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses including reasonable legal fees and disbursements in connection therewith and interest chargeable asserted against or incurred by FAST INTERNATIONAL TRAVELS AND TOURS or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty or agreement made or obligation to be performed by the User pursuant to this agreement. The user shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and FAST INTERNATIONAL TRAVELS AND TOURS cannot be held responsible for the same.
Right to refuse to provide Services
FAST INTERNATIONAL TRAVELS AND TOURS of its discretion, reserves the right not to accept any customer order without any reason. Any contract to provide any service by FAST INTERNATIONAL TRAVELS AND TOURS is not complete , until full payment is made towards the service received from the customer and accepted by FAST INTERNATIONAL TRAVELS AND TOURS.
Without prejudice to the other remedies available to FAST INTERNATIONAL TRAVELS AND TOURS under this agreement, the TOS or under applicable law, FAST INTERNATIONAL TRAVELS AND TOURS may limit the user's activity, end or suspend the user's listing or even terminate the user's registration immediately temporarily/indefinitely, and refuse to provide the user with access to the web portal on the event that:
FAST INTERNATIONAL TRAVELS AND TOURS is unable to verify or authenticate any information provided by the user;
FAST INTERNATIONAL TRAVELS AND TOURS believes that the user's actions may infringe on any third party rights or breach any prevailing law or otherwise result in any liability for the user.
FAST INTERNATIONAL TRAVELS AND TOURS may in its sole discretion reinstate suspended users. Once the user have been indefinitely suspended the user shall not register or attempt to register with FAST INTERNATIONAL TRAVELS AND TOURS or use the website in any manner until such time that the user is reinstated by FAST INTERNATIONAL TRAVELS AND TOURS.
Although the user breaches this agreement, the TOS or the rules and regulation it incorporates, FAST INTERNATIONAL TRAVELS AND TOURS reserves the right to recover any amounts due and owing by the user to FAST INTERNATIONAL TRAVELS AND TOURS or the service provider and to take strict legal action as FAST INTERNATIONAL TRAVELS AND TOURS deems necessary.
Right to Cancellation in Case of Invalid Information from User
The User expressly undertakes to provide to FAST INTERNATIONAL TRAVELS AND TOURS only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts. Any default on part of the User would void this agreement and shall disentitle the User from availing the services from FAST INTERNATIONAL TRAVELS AND TOURS.
In case FAST INTERNATIONAL TRAVELS AND TOURS discovers or has sufficient reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented FAST INTERNATIONAL TRAVELS AND TOURS in its discretion shall have the right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior notification to the User. In such an event, FAST INTERNATIONAL TRAVELS AND TOURS shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services.
The User unequivocally indemnifies FAST INTERNATIONAL TRAVELS AND TOURS of any such claim or liability and shall not hold FAST INTERNATIONAL TRAVEL responsible for any loss or damage arising out of measures taken by FAST INTERNATIONAL TRAVELS AND TOURS for safeguarding its own interest and that of its genuine customers. This would also include FAST INTERNATIONAL TRAVELS AND TOURS denying/cancelling any bookings on account of suspected fraud transactions.
Interpretation
The terms and conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine, feminine and neuter form.
Severability Clause
If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.
Headings and Sub-headings of the Agreement
The headings and subheadings stated in this agreement are merely for the convenience and identification Purpose. It is not intended to define, interpret, describe, or limit the scope, extent of this agreement, terms and conditions, notices, or the right to use this web portal by the User contained or any other section or pages of FAST INTERNATIONAL TRAVELS AND TOURS's portal or any provision in any manner whatsoever. In the event that any of the terms, conditions, and notices contained in this agreement contradicts with the additional terms or other terms and guidelines contained within any particular FAST INTERNATIONAL TRAVEL FAST INTERNATIONAL TRAVELS AND TOURS 's portal, then these terms shall be prevailed.
Relationship
The Relationship between FAST INTERNATIONAL TRAVELS AND TOURS and all B2B/ B2C users shall be contractual relationship Govern by the prevailing laws of Nepal. There shall be no partnership and principal and agent relationship between User and FAST INTERNATIONAL TRAVELS AND TOURS.
Updating of the Information
FAST INTERNATIONAL TRAVELS AND TOURS provides services with reasonable diligence and care to ensure the User does not face any inconvenience. However, in some cases, the information, software, products, and services included in or available through the FAST INTERNATIONAL TRAVELS AND TOURS's portal may include inaccuracies or typographical errors which will be immediately corrected as soon as FAST INTERNATIONAL TRAVELS AND TOURS notices them. Changes may be periodically made to the information provided.
Without any notice to the User, FAST INTERNATIONAL TRAVELS AND TOURS may make improvements or changes in the FAST INTERNATIONAL TRAVELS AND TOURS portal at any time. If the User (the Customer) need or wish to provide any advice to us, it should be provided in writtten mail to concern mail address provided.
